1. About These Terms

1.1 These Terms of Use ("Terms") govern your access to and use of the FundBright website at www.fundbright.sg, any FundBright mobile application, and any related services we provide (together, the "Platform"). They form a legally binding agreement between you and FundBright.

1.2 By creating an account, submitting a loan enquiry, or otherwise using the Platform, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use the Platform.

1.3 If you are using the Platform on behalf of an entity, you represent that you have authority to bind that entity to these Terms.


2. About FundBright (Please Read Carefully)

2.1 FundBright is not a lender. We do not provide loans, hold deposits, or extend credit. We do not hold a moneylending licence and we are not a bank, finance company, or licensed moneylender.

2.2 FundBright is not regulated by the MAS (Monetary Authority of Singapore) or MinLaw (Ministry of Law's Registry of Moneylenders). We operate only as a technology platform that connects you with banks (regulated by MAS) and licensed moneylenders (regulated by MinLaw).

2.3 FundBright is not a financial adviser. Nothing on the Platform constitutes financial, investment, legal, tax, or other professional advice. We do not recommend any specific loan, lender, or product to you. Information provided on the Platform is for general information only.

2.4 FundBright does not act as the agent of any lender or borrower. We are an independent intermediary that operates a digital platform connecting borrowers with licensed lenders ("Lending Partners"). We are not authorised to make commitments, accept applications, or grant loans on behalf of any Lending Partner.

2.5 What FundBright does: we operate a Platform that allows you to submit a loan enquiry once and receive Conditional Offers from multiple Lending Partners. A "Conditional Offer" is a non-binding, preliminary proposal of loan terms generated by a Lending Partner. We facilitate the matching of borrowers with Lending Partners, but the loan itself is offered, granted, and serviced solely by the Lending Partner you select.

2.6 Decisions are yours. Any decision to apply for, accept, or decline a loan is your decision alone. You should review each Conditional Offer carefully, including its interest rate, fees, repayment schedule, and other terms, and seek independent advice if you are unsure.


3. Eligibility

3.1 To use the Platform, you must:

  • be at least 21 years old;
  • be a Singapore citizen or Singapore permanent resident;
  • be legally capable of entering into a binding contract;
  • not be an undischarged bankrupt and not be subject to any bankruptcy proceedings;
  • not be a Politically Exposed Person (PEP) for the purposes of the Lending Partners we work with; and
  • be using the Platform for lawful, personal purposes.

3.2 We may decline or terminate access if we reasonably believe any of these requirements is not met. Eligibility for any specific Conditional Offer or loan is determined by the relevant Lending Partner, not by FundBright, and may involve additional criteria (such as minimum monthly income and employment status).


4. Your Account

4.1 To use the full features of the Platform, you must register an account. When you register, you agree to:

  • provide accurate, current, and complete information;
  • keep your password and authentication credentials secure and confidential;
  • not share your account or login credentials with any other person;
  • promptly notify us of any unauthorised access to or use of your account;
  • update your information when it changes.

4.2 You are responsible for activity that occurs under your account, except activity arising after you have notified us of unauthorised access (and we have had a reasonable opportunity to act on that notice).

4.3 We may use Singpass / MyInfo authentication for account creation and identity verification. If you choose to use Singpass / MyInfo, our handling of the data we receive is described in our Privacy Policy.

4.4 We may suspend, restrict, or terminate your account in accordance with section 13.


5. How the Matching Service Works

This section explains the operational reality of using the Platform. It is consistent with our Privacy Policy.

5.1 Submitting a loan enquiry

When you submit a loan enquiry, you provide information about yourself, your finances, and the loan you are looking for. You confirm that the information you provide is true, accurate, and complete to the best of your knowledge.

5.2 Matching with Lending Partners

We share information from your enquiry with selected Lending Partners on an anonymised basis. At this stage, we do not share your name, contact details or residential address. We share only information relevant to the Lending Partner's underwriting assessment.

5.3 Conditional Offers

Lending Partners may respond by issuing one or more Conditional Offers. Conditional Offers are not binding loan commitments. They reflect a Lending Partner's preliminary view based on the anonymised information we have shared. The Lending Partner's final loan terms (if any) will depend on its own assessment, including verification of the information you have provided, its own credit checks, and any regulatory checks required.

A Conditional Offer will typically specify the approved loan amount, monthly instalment, monthly interest rate, administrative fee, and loan tenure.

5.4 Accepting a Conditional Offer

You may accept a Conditional Offer through the Platform by selecting the Conditional Offer in your account dashboard. By doing so, you authorise FundBright to share your full identifying information (including full name and contact details, but not your NRIC / FIN) with the relevant Lending Partner so they can complete their final assessment, contact you, and (if approved) finalise the loan. Your NRIC / FIN will be collected by the Lending Partner directly from you at the in-person verification meeting at their place of business.

You may also choose to decline a Conditional Offer or take no action. Submitting an enquiry does not commit you to taking any loan.

5.5 Final loan terms come from the Lending Partner

After your acceptance, the Lending Partner will conduct face-to-face KYC verification, complete its credit assessment, and decide whether to grant the loan. The final terms of the loan will be set out in the loan agreement you sign with the Lending Partner. The final loan terms may differ from the Conditional Offer, for example, if information you have provided is inaccurate, incomplete or cannot be verified; or if the Lending Partner identifies a material risk during its final assessment.

5.6 The loan agreement is between you and the Lending Partner

If you proceed with a loan, the loan agreement is solely between you and the Lending Partner. FundBright is not a party to that agreement, has no role in its performance, and has no liability for it. The Lending Partner is solely responsible for:

  • approving or rejecting your application;
  • the final terms of the loan;
  • disbursing the loan;
  • collecting repayments;
  • providing customer service for the loan;
  • complying with applicable regulations including the Moneylenders Act 2008 and the Moneylenders Rules 2009 (where the Lending Partner is a licensed moneylender) or banking regulations (where the Lending Partner is a bank or finance company);
  • handling complaints relating to the loan.

5.7 Use of your contact details after acceptance

The Lending Partner whose offer you accept may use your contact details only for final KYC verification, executing the loan agreement, and subsequent loan servicing or debt collection. The Lending Partner is contractually prohibited from using those contact details to cross-sell or market unrequested financial products to you.


6. Fees and How FundBright is Paid

6.1 Use of the Platform is free for you. We do not charge you any fee for submitting a loan enquiry, receiving Conditional Offers, or accepting a Conditional Offer.

6.2 We are paid a platform fee by Lending Partners for each successful loan referral. This is how we earn revenue.

6.3 The platform fee is paid by the Lending Partner, not by you. The total cost of any loan you take, including all interest, administrative fees, and other charges, will be fully disclosed in the loan documents you sign with the Lending Partner. You should read those documents carefully before signing.

6.4 FundBright does not invoice you directly for any amount.


7. Information Accuracy and Your Representations

7.1 You represent and warrant that:

  • all information you provide on the Platform is true, accurate, complete, and not misleading;
  • you have the right to provide that information and to authorise us to use it as described in the Privacy Policy;
  • you are submitting the loan enquiry on your own behalf and for your own purposes; and
  • you are not currently an undischarged bankrupt and are not subject to any bankruptcy proceedings.

7.2 You acknowledge that providing false or misleading information to a licensed moneylender or to a bank in connection with a loan application may constitute an offence under Singapore law, and may also be the basis for the Lending Partner refusing or terminating the loan.

7.3 We rely on the information you provide. We are not responsible for losses you suffer because the information you gave us was incorrect, incomplete, or out of date.


8. No Advice; No Recommendation; Loan Information Presentation

8.1 FundBright presents Conditional Offers and information from Lending Partners. We do not recommend or endorse any Lending Partner or Conditional Offer, and the order in which offers are displayed does not represent any view by FundBright as to which is best for you.

8.2 Where the Platform contains content from a Lending Partner about its loan products, that content is the responsibility of the Lending Partner. We make reasonable efforts to display the content accurately as provided by the Lending Partner, but we do not independently verify every detail of every offer.

8.3 If you believe any information about a Lending Partner or its loan product on the Platform is inaccurate or misleading, please contact us promptly using the details in section 16.


9. Educational Content and Tools

9.1 The Platform may contain educational content, articles, calculators, and similar tools (the "Educational Content"). The Educational Content is provided for general information only.

9.2 The Educational Content does not take into account your personal circumstances and is not financial advice. We make no warranty as to its completeness, accuracy, or applicability to your situation. You should not rely on the Educational Content as a substitute for advice from a qualified professional.

9.3 Calculators on the Platform produce illustrative figures only. Actual loan terms, interest, fees, and repayments will be determined by the Lending Partner and may differ from any calculator output.


10. Acceptable Use of the Platform

10.1 You agree to use the Platform only for lawful purposes and in compliance with these Terms. You will not:

  • use the Platform to submit any false, misleading, or fraudulent information;
  • use the Platform on behalf of another person without their authorisation;
  • submit a loan enquiry while you are an undischarged bankrupt or subject to bankruptcy proceedings;
  • use the Platform to obtain a loan for the purpose of gambling or paying gambling debts;
  • attempt to access the Platform's systems, accounts, or data without authorisation;
  • interfere with, disrupt, or damage the Platform, its systems, or its security features;
  • introduce any virus, malware, or other harmful code to the Platform;
  • reproduce, copy, scrape, or commercially exploit any part of the Platform or its data, except as permitted by these Terms;
  • use the Platform in any way that could damage, disable, overburden, or impair our systems or the experience of other users;
  • impersonate any person, misrepresent your affiliation with any person, or use the Platform to harass or abuse any other user, employee, or representative of FundBright or any Lending Partner.

10.2 We reserve the right to investigate suspected breaches and take appropriate action, including suspending or terminating your account, removing content, and reporting suspected criminal activity to the relevant authorities.


11. Information About Loans and Licensed Lenders

11.1 FundBright works with licensed banks, finance companies, and licensed moneylenders. We do not work with unlicensed lenders or loan sharks.

11.2 You can verify the licence status of any licensed moneylender on the Ministry of Law's Registry of Moneylenders website. We carry out reasonable onboarding due diligence on Lending Partners, but you should make your own enquiries before entering into any loan.

11.3 If you suspect any person of operating as an unlicensed moneylender or attempting to use the Platform for unlawful lending, please report this to FundBright and to the Singapore Police Force.


12. Intellectual Property

12.1 All intellectual property rights in the Platform, including its design, software, content, logos, branding, and structure, are owned by or licensed to FundBright. We grant you a personal, non-exclusive, non-transferable, revocable licence to access and use the Platform for the purposes described in these Terms.

12.2 You must not reproduce, modify, distribute, sell, lease, license, or create derivative works from the Platform or its content, except as expressly permitted by these Terms or by Singapore law.

12.3 Trademarks of FundBright and of Lending Partners are the property of their respective owners and may not be used without written consent.

12.4 Where you submit feedback, suggestions, or ideas about the Platform, you grant us a perpetual, worldwide, royalty-free licence to use those suggestions to improve the Platform, with no obligation to compensate you. (For the avoidance of doubt, this clause does not apply to your personal data, which is governed by the Privacy Policy.)


13. Suspension and Termination

13.1 You may stop using the Platform and close your account at any time by contacting us. Closing your account does not affect any loan you already have with a Lending Partner — that loan continues to be governed by your agreement with the Lending Partner.

13.2 We may suspend, restrict, or terminate your access to the Platform (with or without notice, depending on the circumstances) if:

  • you are in breach of these Terms (including Section 10);
  • we reasonably suspect that you have provided false or misleading information, or that your use of the Platform involves fraud, money laundering, terrorism financing, or other illegal activity;
  • we are required to do so by law or by a regulator, court, or law-enforcement agency;
  • continuing to provide the Platform to you would expose us, a Lending Partner, or another user to material risk; or
  • we cease to operate the Platform in part or in whole.

13.3 We will give you reasonable notice where this is practicable and consistent with our legal obligations. Where notice is not practicable (for example, because of an active fraud investigation or a regulatory requirement), we will notify you as soon as we reasonably can.

13.4 On termination, sections that by their nature should survive (including sections 5.6, 12, 14, 15, 17, and 18) will continue in effect.


14. Liability

14.1 We do not exclude or limit anything that cannot be excluded or limited by law, including liability for fraud, fraudulent misrepresentation, gross negligence, wilful misconduct, death or personal injury caused by negligence, or any liability that cannot be excluded under the Consumer Protection (Fair Trading) Act 2003, or other applicable Singapore law.

14.2 What FundBright is responsible for. Subject to section 14.1 and the cap in section 14.4, FundBright is responsible for:

  • operating the Platform with reasonable care and skill;
  • handling your personal data in accordance with the Privacy Policy and applicable data protection laws;
  • accurately transmitting Conditional Offers from Lending Partners to you, and accurately transmitting your enquiry information to Lending Partners.

14.3 What FundBright is not responsible for. Subject to section 14.1, FundBright is not responsible for:

  • any act, omission, decision, or default of any Lending Partner — including any decision to grant or refuse a loan, the final terms of a loan, the disbursement, servicing, or collection of a loan, or any breach by the Lending Partner of its agreement with you or applicable law;
  • the accuracy or completeness of information you provide, or any consequence of you providing inaccurate or incomplete information;
  • interruptions, errors, or unavailability of the Platform that are not due to FundBright's negligence;
  • loss caused by your use of any third-party service (such as Singpass, your bank, or your internet service provider);
  • indirect, consequential, special, or incidental losses, including loss of profit, loss of business, loss of opportunity, or loss of reputation.

14.4 Cap on liability. Subject to section 14.1, FundBright's total aggregate liability to you in connection with the Platform, in any 12-month period, is limited to the total fees you have paid to FundBright during that period for use of the Platform.

14.5 Nothing in this section 14 affects your rights as a consumer under Singapore law that cannot be excluded by contract.


15. Indemnity

15.1 You agree to indemnify FundBright and its directors, officers, employees, and agents against losses, claims, damages, and reasonable legal costs arising directly from:

  • your breach of these Terms (including Section 10);
  • your provision of false, misleading, or fraudulent information through the Platform;
  • your unlawful use of the Platform; or
  • any claim made against FundBright by a Lending Partner or any other third party arising from your use of the Platform or from information you have provided through the Platform.

15.2 This indemnity does not apply to the extent the loss was caused or contributed to by FundBright's own gross negligence, wilful misconduct, or fraud.

15.3 We will give you prompt notice of any claim for which we seek indemnification, allow you to participate in the defence, and not settle any claim without your prior written consent (which you must not unreasonably withhold).


16. Complaints, Disputes, and How to Contact Us

16.1 If you have a complaint about the Platform or our service, please contact us first at hello@fundbright.sg. We aim to acknowledge complaints within 3 business days and substantively respond within 14 business days.

16.2 If your complaint relates to a Conditional Offer or to the conduct of a Lending Partner, you should also raise it directly with the Lending Partner. The escalation routes available to you depend on the type of Lending Partner:

  • Licensed moneylenders: You may lodge a complaint with the Registry of Moneylenders, Ministry of Law (MinLaw):
  • Banks and finance companies: If the Lending Partner has not resolved your complaint within 4 weeks, you may escalate to the Financial Industry Disputes Resolution Centre (FIDReC) at https://www.fidrec.com.sg.

16.3 Threats, harassment, or unlawful collection: If a Lending Partner or any other person engages in threatening, harassing, or unlawful collection conduct, please contact the Singapore Police Force (999 in an emergency) and report the incident to us.

16.4 If we are unable to resolve your complaint, you may pursue any other remedy available under Singapore law.


17. Changes to the Platform and These Terms

17.1 We may add, modify, or discontinue features of the Platform at any time. We may release features that are still being tested and labelled as "beta" or similar.

17.2 We may amend these Terms from time to time. Where the change is material — for example, a change that significantly affects your rights, obligations, fees, or the way the Platform works — we will give you reasonable notice (typically by email and through a notice on the Platform) before it takes effect.

17.3 If you do not agree to a material change, you should stop using the Platform and close your account before the change takes effect. Continuing to use the Platform after the change takes effect means you accept the updated Terms.


18. Other Important Terms

18.1 Assignment. We may assign or novate our rights and obligations under these Terms to an Affiliate, or to a successor in a corporate transaction (such as a merger or sale), with notice to you. You may not assign your rights or obligations under these Terms without our written consent.

18.2 Severability. If any provision of these Terms is found to be unenforceable, the remaining provisions continue in effect. Where possible, the unenforceable provision will be read down to the extent necessary to make it enforceable.

18.3 No waiver. A failure or delay by FundBright in enforcing a right under these Terms does not waive that right.

18.4 Entire agreement. These Terms and the Privacy Policy together set out the agreement between you and FundBright relating to the Platform. They supersede any prior representations or agreements about the Platform.

18.5 Third-party rights. A person who is not a party to these Terms has no right under the Contracts (Rights of Third Parties) Act 2001 to enforce any provision of these Terms.

18.6 Governing law and jurisdiction. These Terms are governed by the laws of Singapore. The Singapore courts have exclusive jurisdiction over any dispute arising from or connected with these Terms.
